GENERAL TERMS AND CONDITIONS OF USE AND RENTAL

These general terms and conditions govern the use (including mere access) of the web pages that are part of Ilse Wissink's website, including the content and services made available on these pages. Any user who accesses our website agrees to be bound by the Terms and Conditions in force at the time of accessing the website. The term "user, tenant or guest" refers to any person who visits our website, browses through it, uses or participates in the services and/or activities carried out on the website and those who reserve/rent accommodation.

RESERVATION AND BOOKING AGREEMENT

Bookings go through Ilse Wissink who mediates between the owner and the user. Accommodation prices are based on current market conditions and are expressed in Euro currency. Ilse Wissink's services are exclusively those stipulated in this contract. Bookings can be made via this website (with automatic debit from your bank account) or directly by email : hello@ilsewissink.com. The booking is only valid after written confirmation. In the latter case, as soon as the user receives the booking form, he/she must pay a deposit (mentioned on the booking form / website) and return the booking form with all completed details to Ilse Wissink. Only after receiving the down payment will the booking be final. The rest of the payment of the rent of the house is done cash on arrival (if less than € 1000,-).

  • Failure to respect the accommodation, furniture and installations.
  • Failure to return all keys handed over on arrival
  • Failure to respect the check out time (unless otherwise agreed: 11:00 am)
  • Failure to leave the accommodation tidy (rubbish must be taken away, no dirty dishes left behind)

Payment conditions and the amount of the deposit are listed on the page of the house in question.


ARRIVAL AND DEPARTURE

Arrival: after 15:00, unless otherwise agreed in writing. Departure: before 11.00 am, unless otherwise agreed in writing. Any change of arrival date and time must be communicated to hello@ilsewissink.com and must be approved by Ilse Wissink at least 7 days in advance. Upon arrival, the user must show the booking form and passport or identity card to the person doing the check-in so that they can proceed with the necessary registrations required by law. When handing over the keys to the tenant, the rental fee, as stated on the booking form, must be paid.

OCCUPANCY OF THE ACCOMMODATION


The number of persons (adults and children) staying in accommodation must not exceed the number of sleeping places indicated on the booking form/registration. Any change of guests during the rental period is prohibited if not agreed in advance. The property may not be used as a party venue without express permission.
Guests must respect cohabitation rules between neighbours and local municipal regulations. Only holidaymakers sleeping in the property may enter the premises and use the facilities. External service providers, including but not limited to cooks, maids, catering companies, waiters, live performers, may offer their services at the property only with the express permission of Ilse Wissink.
Guests not sleeping in the villa may not participate in any reception, dinner or party organised on the premises without prior permission from Ilse Wissink. Ilse Wissink may refuse this permission or request not to exceed a maximum number of guests. Ilse Wissink may also request that an additional amount be paid by the tenant or that personally trusted service providers be hired. Refusal of permission shall not give rise to cancellation of the booking or modification of the cancellation conditions. Exceptions to the above must be arranged before completing the booking process. As such, holidaymakers are strongly advised to make their intentions known before completing the booking process.

CLEANLINESS - CLEANING - MAINTENANCE

The holiday homes will be left clean, tidy and in good condition. If specified in the booking confirmation, the tenant is obliged to pay the amount due for the final cleaning of the property. However, this amount does not include the cleaning of the kitchen regarding dirty dishes, etc., nor the removal of waste, which are the responsibility of the tenant. If this has not been done, Ilse Wissink is forced to charge extra costs. Costs for final cleaning and other local expenses should be paid to Ilse Wissink in the amounts as mentioned on the booking confirmation. . It is strictly forbidden to drag furniture from the house to the terrace or swimming pool!

Mosquitoes, lizards, cockroaches, ants and other insects are indigenous inhabitants. They are attracted to human presence and can be found in the holiday home. This is considered normal and the presence of a quantity of insects in a holiday home or outdoor areas does not give rise to any compensation. Household pesticide to discourage insects from entering the property is available from the local supermarket and Ilse Wissink will advise on best practice on request.

THE ACCOMMODATION

It is understood that the properties offered by Ilse Wissink are not official tourist structures, such as hotels, residences, etc., but private houses. As such, they have no internationally recognised standards or categories, but reflect the local traditions and personal taste of the owner in their architecture and furnishings. And this is exactly the kind of holiday we offer: a stay in the culture of the region, a few weeks in the same environment as someone from the region.


SWIMMING POOL


The water of all public and private swimming pools is treated with chemicals (including, but not limited to, chlorine and algaecides) for disinfection and sanitary purposes. The homeowner or his representative is obliged to treat the water with the appropriate amount of specific chemical agents and the holidaymaker cannot at any time request that the treatment not be carried out. Holidaymakers who are allergic to the chemicals commonly used in this mandatory water treatment should not use the pool or use it at their own risk.
If the tenant cannot use the pool due to a reaction to the chemicals used for the water treatment, this cannot give rise to any compensation. The tenant must be careful with small children at the pool and an adult must always be present when children are using the pool. Use of the pool is at the holidaymaker's own risk.

EXTERNAL MAINTENANCE

The owner or his representative have free access to the property for necessary maintenance (garden, swimming pool, etc.) when necessary.

CHANGES - CANCELLATION - PRICES

If the number of guests/occupancy changes, you must inform Ilse Wissink in writing at least one week before arrival. In case of flight changes and change of dates, you must inform Ilse Wissink immediately. If this does not cause problems with other bookings, it can be changed, provided the minimum number of nights is respected, the price will be adjusted to the new booking.


In case of cancellation of a booking, even if it is replaced by another, Ilse Wissink will charge a fee. Look for the cancellation costs on the confirmation of your (online) booking, where these costs are indicated.

Homeowners can submit price changes 2 months before the end of the contract. This may result in price changes for your existing booking. Ilse Wissink will then have to pass these on.
Of course, this will be communicated as soon as possible, in which case a cost-free cancellation on your part is possible.


INCIDENTS / COMPLAINTS

If you have an unexpected complaint, you (the tenant) should immediately contact Ilse Wissink by phone (+34 628 549 089) or by email: hello@ilsewissink.com. This should be done on the day of arrival and no later than 2 days after arrival, with written confirmation of complaints within 24 hours. The tenant is obliged to give Ilse Wissink the necessary time to solve the problem. Anyone who leaves the holiday home prematurely without the express permission of Ilse Wissink and without the above-mentioned written notification will lose all rights to any refund of the rental fee. No complaint made upon return from the stay will be taken into consideration nor give rise to any compensation. No demand for compensation submitted on the day before departure or afterwards will be taken into consideration.
If Ilse Wissink is unable to make the accommodation she has booked available to the client for any reason, including force majeure, she reserves the right to transfer the guests to an equivalent accommodation by mutual agreement. If the price of the replacement accommodation is lower, the difference shall be refunded to the client, but if the price of the replacement accommodation is higher, the difference shall be paid by Ilse Wissink. However, if no agreement can be reached, both contracting parties are authorised to dissolve the agreement. Ilse Wissink will refund the tenant only the deposit, any other form of refund is excluded.

LEGAL LIABILITY

The descriptions in our property information are accurate and prepared in good faith. However, Ilse Wissink disclaims all responsibility for any changes made by the owners without its knowledge. Ilse Wissink or the owner are not responsible for any physical injury caused to holidaymakers during their stay in the property. It is therefore strongly recommended that clients take out comprehensive travel insurance prior to their trip.
Ilse Wissink or homeowner cannot be held liable in any way in the following cases:

  • irregularities due to third parties regarding water supply, electricity, gas, telecommunications, etc.
  • nuisance or noise caused by public or private works, events or manifestations taking place outside the area of the rented accommodation.
  • loss, theft or damage suffered by persons or things in the accommodation and its facilities, whatever the cause, such use being the strict responsibility of the user.
  • The presence of dogs and cats in rural or urban areas is considered normal, as is the noise associated with them, which cannot be controlled by Ilse Wissink.


Under no circumstances can Ilse Wissink be held liable for matters, whose responsibility lies with the owners of the accommodation. Ilse Wissink monitors all offered accommodations as strictly as possible, because maintaining a correct price-quality ratio is her highest priority. The accommodations are therefore constantly checked in this respect.


Ilse Wissink and/or owner accept no liability for any injury, death, loss, inconvenience or damage, nor for change, delay or cancellation of booking due to war, threat of war, riot or civil disturbance, terrorist activities (imminent or actual), pandemic, natural disaster, fire, illness, weather conditions, action at an airport or port by a government or public authority, technical problems relating to transport and airport regulations caused by technical, mechanical or electrical failures, affecting the (duration of the) stay in the accommodation amounting to 'force majeure' or other similar events beyond the control of Ilse Wissink / owner.

Under no circumstances can Ilse Wissink be held liable for matters that are the responsibility of the owner of the accommodation, such as the maintenance of the accommodation.
Ilse Wissink's role as mediator between owner and tenant also includes helping to resolve any complaints about the above-mentioned points, provided they are reported in time and after assessment of correctness.

HOME RULES

When staying in accommodation, the following house rules are to be observed by the client:

  • On arrival, a CHECK-OUT time will be agreed with the customer (no later than 10.00 am, unless otherwise agreed) We ask you to be ready to leave at the agreed time, to have tidied up the house neatly and to have taken rubbish and empty bottles to the waste container.
  • The remote controls of TV, DVD, air conditioning etc. as you found them, with the relevant device.
  • As water is scarce on the island, please use it sparingly. It may happen that the water is cut off for a while due to a malfunction. If this is the case, please let us know and we will do everything (in our power) to have it fixed as soon as possible.
  • The tap water is not drinkable in most cases, it is best to buy drinking water in the supermarket.
  • The same goes for electricity, often the installation is not designed to handle many electrical appliances at the same time.
  • Please do not leave the pool lights on during the day. The lamps break down quickly if they overheat. Some villas have a timer for this purpose.
  • Do not use the air conditioner when doors and windows are open. If the air conditioner is turned on in the bedrooms 10 minutes before bedtime, this is time enough to have a cool bedroom. Normal temperature is 21 - 23 degrees. It is unnecessary to set the air conditioning to 16 or 17 degrees, this overloads the electrical system, and is also bad for your health.
  • Please fold the umbrellas when leaving the house, going to bed and in strong winds, and secure doors and windows. In case of damage, we are obliged to retain part of the deposit.
  • In case of unexpected rain, please bring the cushions of chairs that can get wet inside, which is more comfortable for yourself when the sun shines again afterwards and better for the preservation of the cushions.
  • Barbecuing is only allowed on the designated fixed BBQ. Loose BBQs are prohibited by Spanish law between 1 May and 31 October. The BBQ must be left clean on departure.
  • We recommend that you regularly take out the rubbish, especially because of pests! This can be deposited in the waste containers located along the road. (Glass, plastic and cardboard separated)
  • Please do not independently change the channels of the satellite receiver and TV.
  • Unfortunately, Gran Canaria is also experiencing increasing crime, so be alert to your belongings and always lock windows and doors securely, even when sitting by the pool.
  • "Parties" in the villa, garden or by the pool are not allowed. Should the police be alerted because of noise nuisance caused by you, expect very high fines.

JURISDICTION


In the event of any dispute arising from the reservation and rental, only the courts of Las Palmas de Gran Canaria and the provisions of local civil law can deal with the matter and only Spanish law will apply. Making a reservation implies that the General Conditions have been understood and thereby accepted without reservation and without exception. If any of the terms of this contract has become or was invalid or if there would be a loophole in this contract, the other terms cannot be disputed.
